LORD’S ONLINE STORE TERMS & CONDITIONS

MCC sells different types of products (Products) on the Lord’s Online Store, store.lords.org and the Lord’s Venue App (Website).

The Website is owned by Marylebone Cricket Club (MCC) of Lord’s Ground, London NW8 8QN. MCC’s VAT number is 229 246948.

The sale of a Product is subject to these Terms & Conditions.

  1. General information
  • Every care has been taken to ensure that the descriptions, colours, photographs and specifications of the Products shown on this Website are correct. However, slight variations in the actual Products may occur and MCC accepts no responsibility or liability for these variations.
  • As it is MCC’s policy continually to improve Products, methods and materials, MCC reserves the right to change specifications from time to time. You may return any Product to us which are not as you expected in accordance with paragraph 10.
  • Any Product sold at a discounted price, as a remnant or as substandard stock, will be identified and stated to be sold as such.
  1. Availability
  • All Products displayed on this Website are subject to availability.
  • MCC regrets that occasionally it may not be possible to complete an order if a Product has been withdrawn or is not available for any reason.
  1. Prices
  • The price of the Products:
    • are in British Pound Sterling (£) (GBP);
    • includes VAT at the applicable rate if you have requested delivery to a United Kingdom address (including Jersey, Guernsey, Isle of Man and a British Forces Post Office (BFPO)); and
    • does not include the cost of delivering a Product, which shall be charged separately, itemised and added to the total amount of the order pursuant to paragraph 8.
  • The prices are as listed on this Website at the time of ordering but please note that foreign currency exchange rates are subject to fluctuations outside the control of MCC.
  • MCC reserves the right to amend prices from time to time, for example in the event of a change in the rate of VAT or supplier.
  • If you have requested international delivery, being a delivery outside United Kingdom (including Jersey, Guernsey, Isle of Man and a BFPO) , the Products will normally be zero-rated for UK VAT purposes, however, you may be subject to the charges detailed at paragraph 15.
  1. Ordering
    • Below, sets out how a legally binding contract between you and MCC is made.
  • If you are under the age of 18, you may not buy any Products from this Website.
  • You place an order for the Product on the Website.
  • Please read and check your order carefully before submitting it including without limitation by ensuring that you have ordered the correct size for the Product (if applicable), the correct quantity and you have checked the available delivery dates.
  • When you place your order at the end of the online checkout process (i.e. when you click on the ‘pay now’ button), MCC will confirm your order by email to the email address you stated when you placed your order (Confirmation Email). At this point a legally binding contract will be in place between MCC and you.
  • When your Order has been dispatched the courier may send you an e-mail or text message notifying you of the estimated delivery date and your tracking reference number.
  • MCC reserves the right to cancel your order after the creation of a legally binding contract at its own discretion and thereby terminating the contract of sale. Examples of when MCC may not accept your order are as follows:
  • a Product is unavailable;
  • MCC cannot authorise your payment;
  • if the Product shown on the Website contains a (manifest) error such as being incorrectly priced or otherwise incorrectly described or shown;
  • MCC is unable to process an order due to technical reasons; or
  • if delivery restrictions apply to a Product.
  • In the event MCC cancels an order pursuant to paragraph 7, MCC will reimburse to you all payments received from you in British Pound Sterling within 28 days after the day on which MCC cancelled an order. Any reimbursement will be made to the original credit or debit card used when you placed the order.
  • Due to cricket matches, large events, Public Holidays and/or Christmas closures (Exclusion Days), MCC may be unable to despatch and deliver during particular times in the year. Please see paragraph 8 for further details.
  1. Payment
    • MCC accepts the following major credit and debit cards: Visa, MasterCard, American Express, Google Pay and Apple Pay together with any other methods which may be clearly displayed on the Website from time to time.
    • MCC will do all that it reasonably can to ensure that all of the information you give to MCC when paying for the Products is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on MCC’s part or any failure by MCC to comply with these Terms & Conditions or MCC’s Privacy Notice (see paragraph 13), MCC will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any payment information that you give to MCC.
    • Your credit or debit card will be charged when you place an order.
    • All payments by credit or debit card need to be authorised by the relevant card issuer.
    • You confirm that the credit or debit card that is being used is yours. 
  2. Right to Cancel
    • You have the right to cancel an order within 14 days without giving any reason.
    • The cancellation period will expire after 14 days from receipt of the Confirmation Email.
    • To exercise the right to cancel, you must inform MCC of your decision to cancel an order by a clear statement to lordsshop@mcc.org.uk.
    • To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
    • Your right to return or cancel Products does not apply to the Products listed in paragraph 8. This does not affect your statutory rights if goods are faulty or not as described.
  3. Effects of Cancellation
    • If you cancel an order, MCC will reimburse to you all payments received from you in British Pound Sterling.
    • MCC will make the reimbursement without undue delay, and no later than 28 days after the day on which MCC received your decision to cancel the order. A reimbursement will be made to the original credit or debit card used when placing your order.
  4. Delivery
    • MCC will deliver Products to the delivery address stated in your order. Delivery will take place on a working day, not being an Exclusion Day.
    • MCC recommends you provide a delivery address where there will always be someone available to accept the delivery.
    • The cost of delivering a Product shall be charged separately, itemised and added to the total amount of your order at the checkout. For international deliveries, the price of delivery is dependent on the destination country and the weight of Products you have ordered. In order to qualify for International Delivery your order must be under 2kg. If your order exceeds 2kg, you will be contacted by a member of MCC’s Retail Department.
    • MCC aims to deliver within the estimated delivery date, however, any delivery date is indicative and therefore not regarded as a strict deadline. MCC shall not be liable for any delay in delivery of the Products, howsoever caused. Please note that personalised items or other bespoke Products may incur longer transit times and varied delivery charges. On occasions, delivery of your order may be delayed or prevented for reasons beyond MCC’s control. When delivering outside of the United Kingdom, delivery may also be delayed due to customs-related processes (such as inspection). MCC will use reasonable endeavours to inform you of any such delay.
    • If something happens which is outside of MCC’s control and affects the estimated date of delivery, MCC will let you have a revised estimated date for delivery of the Product.
    • Depending on stock availability, MCC may split delivery of an order into several parts. You will not be charged extra for this.
    • Delivery will take place when MCC delivers the Product to the address stated in your order and ownership of the Product shall pass to you. After delivery, the Product will be held at your own risk and MCC will not be liable for any loss, damage or destruction to the Product, except insofar as it arises from a latent defect.

United Kingdom Delivery

  • Deliveries may be sent to addresses anywhere in the United Kingdom including Jersey, Guernsey, Isle of Man and a BFPO. Parcels addressed to BFPO will only be tracked up to handover to the BFPO UK address and must conform to BFPO addressing guidelines detailed on BFPO’s website.
  • If the initial delivery attempt is unsuccessful, a second delivery will be attempted the following working day. If the second delivery is unsuccessful, a ‘Something for you’ delivery card will be left at the delivery address stated in your order with instructions of where to collect your order i.e. at your local delivery office.
  • If you have not collected your order from your local delivery office by the specified day or time on the ‘Something for you’ delivery card, the Products will be returned to MCC.
  • If you have not received your order five working days after the estimated delivery date, please call MCC on 020 7616 8570 (10am to 5pm Monday to Friday, excluding Exclusion Days) or email lordsshop@mcc.org.uk. Please ensure that you have your order number and tracking number when contacting MCC.

International Delivery

  • MCC offers international delivery on certain Products to certain countries. There are some Products that are unavailable for International Delivery due to reasons outside MCC’s control such as legal restrictions, warranties or logistical limitations. Please be aware that MCC may be unable to deliver to certain countries and any quarantine seizures are outside of MCC’s control. MCC will not reimburse you for any Products seized or delayed by quarantine in a country. If you are concerned, please contact your local quarantine authority for guidance.
  • Unless otherwise stated, all Products are shipped from the United Kingdom and may incur duty and other charges upon entering other countries. Any duty, clearance, tax or carrier charges must be borne by the recipient and MCC will not accept liability for any such duties, costs or charges.
  • Unfortunately, MCC has no control over any duty, clearance, tax or carrier charges and cannot predict what they may be, so MCC is unable to offer any assistance as regards these.
  • Please note that the recipient of the Product, not the person placing the order, will typically receive a separate request for payment of any duty, clearance, tax or carrier charges when the Product arrives in the country of destination. Therefore, if you are ordering a Product to be delivered to someone else, please ensure they are aware that they will be responsible for any duty, clearance, tax or carrier charges.
  • All international deliveries use a tracked service and must be signed for on receipt.
  • If you have not received your order five working days after the estimated delivery date, please call MCC on 020 7616 8570 (10am to 5pm Monday to Friday, excluding Exclusion Days) or email lordsshop@mcc.org.uk. Please ensure that you have your order number and tracking number when contacting MCC.
  1. Order tracking

You can track your order status at any time following receipt of the tracking reference number under paragraph 4.6. Once you have received your tracking reference number, simply click on the link provided, or here to obtain an update on your order.

  1. Returns and Exchanges
  • Subject to paragraph 8, you may return an unwanted Product, within 28 days to receive a full refund or replacement on the condition that the Product is unused and in a saleable condition within its original and undamaged packaging.
  • If a Product is damaged on receipt of delivery or contains an error made by MCC (Defective Product), you can return it within 28 days of delivery.
  • When returning an unwanted Product or Defective Product, please email: lordsshop@mcc.org.uk with:
    • the order reference number;
    • your full name, email address and delivery address;
    • contact telephone number;
    • the date; and
    • the reason for returning the unwanted Product or Defective Product and whether you are seeking a replacement or a reimbursement.

Please ensure you include your original dispatch note with your return

  • Please return any unwanted Product or Defective Product to: Lord’s Shop, Marylebone Cricket Club, Lord’s Ground, London NW8 8QN.
  • Provided that the unwanted Product or Defective Product is returned in its original condition, MCC shall replace or reimburse you in British Pound Sterling within 28 days after the day MCC received back from you, the unwanted Product or Defective Product. Any reimbursement will be made to the original credit or debit card used when you placed your order. Please be aware that you will not be entitled to a refund if Products are returned to MCC in an unacceptable or used condition, as determined by MCC in its reasonable opinion.
  • If you need to return an unwanted Product or Defective Product because of an error by MCC, MCC will refund your delivery charges in returning it.
  • MCC cannot be held responsible for any returned packages containing the unwanted Product or Defective Product lost in transit. As you are responsible for returning the unwanted Product or Defective Product, MCC recommends sending the packages by recorded or special delivery.
  • With the exception of Defective Products, and taking into account your statutory rights, please note that the following Products are unable to be returned or exchanged:
  • face coverings, underwear, swimwear and nightwear; and
  • any personalised items or bespoke orders.
  1. Limitation of liability

MCC’s total liability to you for any claim by you arising out of your order and/or these Terms & Conditions shall not exceed the price of the Products supplied, together with, in the case of Defective Products or incorrect deliveries, any delivery charges incurred by you. MCC shall not be liable for any indirect or consequential loss, including without limitation, financial loss such as loss of profit or otherwise, whether this arises from a breach of duty in contract or in any other way. MCC cannot accept any liability for a failure to comply with specific instructions stated on your order form. This condition does not affect your statutory rights.

  1. Events beyond MCC’s reasonable control

MCC will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause that is beyond its reasonable control. This condition does not affect your statutory rights.

  1. Data protection
  • MCC’s Privacy Notice is available at lords.org/privacynotice.
  • Your privacy and personal information are important to MCC. Any personal information that you provide to MCC will be dealt with in accordance with the Privacy Notice, which explains what personal information MCC collects from you, how and why MCC collects, stores, uses and shares such information, your rights in relation to your personal information and how to contact MCC and supervisory authorities if you have a query or complaint about the use of your personal information.
  1. Access to the Website

Whilst MCC will try to ensure that availability of this Website will be uninterrupted and that transmissions will be error-free, however, due to the nature of the Internet, this cannot be guaranteed. Also, your access to this Website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. MCC will attempt to limit the frequency and duration of any such suspension or restriction.

  1. Copyright and database rights
  • You acknowledge that all content included on this Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, as between MCC and you, is the property of MCC, shall remain vested in MCC and is protected by UK and international copyright laws.
  • You are permitted to use the content only as expressly authorised by MCC. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract for re-utilisation any parts of this Website without MCC express written consent and nor may you create or publish your own database that features substantial parts of this Website (e.g. MCC’s prices and Product listings) without MCC’s prior express written consent.
  • Alteration of service or amendments to these Terms & Conditions

MCC reserves the right to make changes to this Website, and these Terms & Conditions at any time. If any of these Terms & Conditions is deemed invalid, void, or for any reason unenforceable, that term or condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

  • Third party rights

No one other than you has any right to enforce any provision of these Terms & Conditions.

  • MCC will try to resolve any disputes with you quickly and efficiently.
  • If you are unhappy with the Products or the service to you, please contact MCC as soon as possible.
  • Law and jurisdiction

These Terms & Conditions shall be subject to English law. All claims or disputes arising in relation to or in connection with any order for Products under these Terms & Conditions shall be governed by English law.

E-GIFT CARD TERMS & CONDITIONS

Purchasing an E-gift card

  1. E-gift cards may be purchased online via https://store.lords.org (Lord’s Online Store) and can be redeemed only on the Lord’s Online Store. E-gift cards may be used in conjunction with other offers, promotions or discounts available via the Lord’s Online Store.
  1. E-gift cards may be purchased in the following denominations: ten Pounds Sterling (£10.00), twenty-five Pounds Sterling (£25.00), fifty Pounds Sterling (£50.00) or one hundred Pounds Sterling (£100.00).
  1. E-gift cards will expire 12 months from the date of purchase. Any remaining balance will be cancelled on the expiry of the 12-month period and the E-gift card will become invalid and no longer available for use.
  1. E-gift cards can be purchased using all available payment methods. However, E-gift cards cannot be used to purchase another E-gift card.
  1. The purchaser will receive the E-gift card by email in the form of a digital code and shall provide that code to the intended recipient. The purchaser will also receive a confirmation email including a copy of the E-gift card.
  1. MCC will not be responsible if an incorrect email address is submitted by the purchaser at the time of purchase of the E-gift card. Therefore, if an E-gift card is sent to the wrong person, it will not be replaced nor will its value be refunded. MCC will not be responsible if an E-gift card is lost or stolen or used without a purchaser’s or recipient’s knowledge or consent.

Using an E-gift card

  1. In order to redeem an E-gift card, the digital code as detailed in the email must be entered into the ‘Gift card and discount code’ section of the checkout on the Lord’s Online Store.
  1. E-gift cards may be used to purchase products of a higher price than the amount on the E-gift card on payment of the difference, including by use of a second or further E-gift card. E-gift cards cannot be used exchanged for cash or used to pay for products or services other than via the Lord’s Online Store at https://store.lords.org/.
  1. If any item purchased with an E-gift card is subsequently exchanged for an item of a lower price, any money owing will be added to the remaining balance on the original E-gift card and will expire 12 months from the original date of purchase of the E-gift card.
  1. If the entire balance on the E-gift card is not spent in a transaction, the remaining balance will be updated after that transaction has been completed.
  1. The balance of an E-gift card may be checked online at the Lord’s Online Store at https:// store.lords.org.
  1. E-gift cards are not valid in store, whether at Lord’s Ground or at any other physical store operated by MCC from time to time. E-gift cards may be redeemed only on the Lord’s Online Store via https://store.lords.org.
  1. E-gift cards are unable to be topped up with further funds by a purchaser or recipient of an E-gift card. If a top-up is required, another E-gift card would need to be purchased.

Returning products purchased with an E-gift card

  1. For details on returning products purchased online with an E-gift card, please see MCC’s Returns Policy.
  1. If a product is purchased online in excess of the value of the E-gift card and paid (in part) using an E-gift card and the extra (in part) paid using another payment method, then after the product has been returned via post, the amount that has been paid via the E-gift card will be credited to the same E-gift card that was used to purchase the products and not by any other means, whether cash, bank transfers or otherwise. The amount paid using another payment method will be credited via that same payment method.

E-gift card exclusions

  1. E-gift cards cannot be exchanged for cash. No change or refund will be given except in accordance with your statutory rights.  Balances remaining on cards may be applied to future purchases, provided that the E-gift card has not expired.
  1. E-gift cards cannot be re-sold.

General

  1. MCC reserves the right to amend, waive or add any further terms & conditions from time to time. Notice of any changes to those terms and conditions will be displayed online at the Lord’s Online Store at https://store.lords.org/.
  1. MCC reserves the right to refuse redemption of an E-gift card where it reasonably believes that the E-gift card has been altered, copied, corrupted or otherwise used in any fraudulent way.
  1. These Terms & Conditions shall be governed by and construed in accordance with English law and you agree that the English courts shall have exclusive jurisdiction to determine any dispute that may arise out of, under, or in connection with these Terms & Conditions.

These are the Terms & Conditions for entry into the draw to win the Prize (as defined below).

 

  1. Definitions

 

In these Terms & Conditions, the following capitalised words and expressions have the meanings set out against them below:

 

Draw: the draw hosted by MCC the Prize to an Entrant;

 

Entrant: any customer who spends over £100.00 at the Lord’s Store but excluding employees of MCC, their families, agents or anyone else connected with the Draw;

 

Lord’s: Lord’s Ground, London NW8 8QN;

 

Lord’s Store: MCC’s online store at https://store.lords.org/;

 

MCC: Marylebone Cricket Club of Lord’s Ground, London NW8 8QN;

 

Prize: signed merchandise from The Hundred; and

 

Terms & Conditions: these terms and conditions.

 

  1. THE DRAW AND entry

 

  • The Draw is run by MCC.

 

  • The Prize is awarded via the Draw. Entrants will automatically be entered into the Draw and will be limited to one entry.

 

  • By spending over £100.00 at the Lord’s Store, Entrants will be deemed to have accepted and agreed to be bound by these Terms & Conditions.

 

  • The Draw opens at 09:00 on 10 December 2024 and closes at 23:59 on 31 January 2025. Any entries received outside this period will not be considered.

 

  • The winning Entrant will be drawn randomly from the entries in the Draw following the closure of the Draw and will be notified as soon as reasonably practicable via the email address linked to the Entrant’s Lord’s Store account (Confirmation Email). The outcome of the Draw selection communicated by MCC is final and no further correspondence will be entered into.

 

  • The winning Entrant must reply to the Confirmation Email within 14 days of the date of the Confirmation Email. In the event the winning Entrant does not comply with this Clause 6, MCC reserves the right to run the Draw again and reallocate the Prize to another Entrant.

 

  • The winning Entrant will receive the Prize as soon as reasonably practicable and the Prize will be sent to the Entrant’s home address linked to the Entrant’s Lord’s Store account.

 

  • MCC is not responsible for any technical glitches or malfunctions or any other problems out of its control that result in an entry into the Draw not being properly received by MCC.

 

  • MCC cannot accept any responsibility for any damage, loss, injury or disappointment suffered by an Entrant as a result of entering the Draw or as a result of not winning the Prize.

 

  • Cash or credit alternatives to the Prize will not be offered in any circumstances and the Prize is not transferable.

 

  • The Prize must not be sold or auctioned for profit under any circumstances.

 

  1. GENERAL

 

  • MCC reserves the right to (i) vary these Terms & Conditions at any time and/or (ii) cancel the use of the Prize of any Entrant who breaches these Terms and Conditions or who has acted fraudulently in any way; and/or (iii) cancel, amend, withdraw, terminate or temporarily suspend the Draw in the event of any unforeseen circumstances or technical reason outside its control, with no liability to any Entrant.

 

  • MCC will not be liable for any loss, expense or damage which is suffered or sustained in connection with the Draw or accepting or using the Prize, except for any liability which cannot be excluded by law.

 

  • Any personal data collected by MCC shall be processed by MCC in accordance with MCC’s Privacy Notice, which may be viewed at org/privacynotice.

 

  • If any provision of these Terms & Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms & Conditions shall otherwise remain in full force and effect and enforceable.

 

  • No third party shall have any right to enforce any of these Terms & Conditions under the Contracts (Rights of Third Parties) Act 1999.

 

  • These Terms & Conditions and the draw shall be governed by and construed in accordance with the laws of England and Wales and the English courts shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms & Conditions.
