LONDON SPIRIT RETAIL TERMS AND CONDITIONS 

London Spirit sells different types of products (Products) on the London Spirit Online Store, store.londonspirit.com (Platform).

The Platform is owned by London Spirit (the Hundred) Limited (LS) of Lord’s Ground, London NW8 8QZ. LS’s VAT number is GB 494 2795 42.

The sale of a Product is subject to these Terms & Conditions.

  1. General information

(a)  Every care has been taken to ensure that the descriptions, colours, photographs and specifications of the Products shown on this Platform are correct. However, slight variations in the actual Products may occur and LS accepts no responsibility or liability for these variations.

(b)  As it is LS’s policy continually to improve Products, methods and materials, LS reserves the right to change specifications from time to time. You may return any Product which is not as you expected in accordance with paragraph 10.

(c)   Any Product sold at a discounted price, as a remnant or as substandard stock, will be identified and stated to be sold as such.

  1. Availability

(a)  All Products displayed on this Platform are subject to availability.

(b)  LS regrets that occasionally it may not be possible to complete an order if a Product has been withdrawn or is not available for any reason.

  1. Prices

(a)  The price of the Products:

(i)        are in British Pound Sterling (£) (GBP);

(ii)        includes VAT at the applicable rate if you have requested delivery to a United Kingdom address (including Jersey, Guernsey, Isle of Man and a British Forces Post Office (BFPO)); and

(iii)       does not include the cost of delivering a Product, which shall be charged separately, itemised and added to the total amount of the order pursuant to paragraph 8.

(b)  The prices are as listed on this Platform at the time of ordering but please note that foreign currency exchange rates are subject to fluctuations outside the control of LS.

(c)   LS reserves the right to amend prices from time to time, for example in the event of a change in the rate of VAT or supplier.

(d)  If you have requested international delivery (being delivery outside United Kingdom including Jersey, Guernsey, Isle of Man and a BFPO) , the Products will normally be zero-rated for UK VAT purposes, however, you may be subject to the charges detailed at paragraph 15.

  1. Ordering

(a)  Below sets out how a legally binding contract between you and LS is made.

(b)  If you are under the age of 18, you may not buy any Products from this Platform.

(c)   You place an order for the Product on the Platform.

(d)  Please read and check your order carefully before submitting it including without limitation by ensuring that you have ordered the correct size for the Product (if applicable), the correct quantity and you have checked the available delivery dates.

(e)  When you place your order at the end of the online checkout process (i.e. when you click on the ‘pay now’ button), LS will confirm your order by email to the email address you stated when you placed your order (Confirmation Email). At this point a legally binding contract will be in place between LS and you.

(f)   When your Order has been dispatched the courier may send you an e-mail or text message notifying you of the estimated delivery date and your tracking reference number.

(g)  LS reserves the right to cancel your order after the creation of a legally binding contract at its own discretion and thereby terminating the contract of sale. Examples of when LS may not accept your order are as follows:

(i)        a Product is unavailable;

(ii)        LS cannot authorise your payment;

(iii)       if the Product shown on the Platform contains a (manifest) error such as being incorrectly priced or otherwise incorrectly described or shown;

(iv)       LS is unable to process an order due to technical reasons; or

(v)       if delivery restrictions apply to a Product.

(h)  In the event LS cancels an order pursuant to this paragraph, LS will reimburse to you all payments received from you in British Pound Sterling. Any reimbursement will be made to the original credit or debit card used when you placed the order.

(i)    Due to cricket matches, large events, Public Holidays and/or Christmas closures (Exclusion Days), LS may be unable to despatch and deliver during particular times in the year. Please see paragraph 8 for further details.

  1. Payment

(a)  LS accepts the following major credit and debit cards: Visa, MasterCard, American Express, Google Pay and Apple Pay together with any other methods which may be clearly displayed on the Platform from time to time.

(b)  LS will do all that it reasonably can to ensure that all of the information you give to LS when paying for the Products is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on LS’s part or any failure by LS to comply with these Terms & Conditions or LS’s Privacy Notice (see paragraph 13), LS will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any payment information that you give to LS.

(c)   Your credit or debit card will be charged when you place an order.

(d)  All payments by credit or debit card need to be authorised by the relevant card issuer.

(e)  You confirm that the credit or debit card that is being used is yours. 

  1. Right to Cancel

(a)  If you purchase a Product online or by any other distance‑selling method, you have 14 days from the day you receive a Product to notify LS that you wish to cancel your order for any reason (Cooling-Off Period).

(b)  Once you have notified LS of your decision to cancel, you then have a further 14 days to return the Product to LS.

(c)   To exercise the right to cancel, you must inform LS of your decision to cancel an order by a clear statement to [email protected].

(d)  Your right to return or cancel Products applies only to online/distance purchases and does not apply to the Products listed in paragraph 10. This does not affect your statutory rights if goods are faulty or not as described (Defective Products). Further information on exclusions is set out in paragraph 10.

  1. Effects of Cancellation

(a)  If you cancel an order, LS will reimburse to you all payments received from you in British Pound Sterling, including the standard cost of delivery.

(b)  LS will make the reimbursement without undue delay, and within 14 days after the day on which LS received your decision to cancel the order, or where applicable, after LS receives the returned Product. A reimbursement will be made to the original credit or debit card used when placing your order.

  1. Delivery

(a)  LS will deliver Products to the delivery address stated in your order. Delivery will take place on a working day, not being an Exclusion Day.

(b)  LS recommends you provide a delivery address where there will always be someone available to accept the delivery.

(c)   The cost of delivering a Product shall be charged separately, itemised and added to the total amount of your order at the checkout. For international deliveries, the price of delivery is dependent on the destination country and the weight of Products you have ordered. In order to qualify for International Delivery your order must be under 2kg. If your order exceeds 2kg, you will be contacted by a member of LS’s Retail Department.

(d)  Delivery dates are estimates only. LS will not be liable for delays caused by events outside its reasonable control. Please note that personalised items or other bespoke Products may incur longer transit times and varied delivery charges. On occasions, delivery of your order may be delayed or prevented for reasons beyond LS’s control. When delivering outside of the United Kingdom, delivery may also be delayed due to customs-related processes (such as inspection). LS will use reasonable endeavours to inform you of any such delay.

(e)  If something happens which is outside of LS’s control and affects the estimated date of delivery, LS will let you have a revised estimated date for delivery of the Product.

(f)   Depending on stock availability, LS may split delivery of an order into several parts. You will not be charged extra for this.

(g)  Delivery will take place when LS delivers the Product to the address stated in your order and ownership of the Product shall pass to you. After delivery, the Product will be held at your own risk and LS will not be liable for any loss, damage or destruction to the Product, except insofar as it arises from a latent defect.

United Kingdom Delivery

(h)  Deliveries may be sent to addresses anywhere in the United Kingdom including Jersey, Guernsey, Isle of Man and a BFPO. Parcels addressed to BFPO will only be tracked up to handover to the BFPO UK address and must conform to BFPO addressing guidelines detailed on BFPO’s Platform.

(i)    If you have not received your order five working days after the estimated delivery date, please call LS on 020 7616 8570 (11am to 4pm Monday to Friday, excluding Exclusion Days) or email [email protected]. Please ensure that you have your order number and tracking number when contacting LS.

International Delivery

(j)   LS offers international delivery on certain Products to certain countries. There are some Products that are unavailable for International Delivery due to reasons outside LS’s control such as legal restrictions, warranties or logistical limitations. Please be aware that LS may be unable to deliver to certain countries and any quarantine seizures are outside of LS’s control. LS will not reimburse you for any Products seized or delayed by quarantine in a country. If you are concerned, please contact your local quarantine authority for guidance.

(k)   Unless otherwise stated, all Products are shipped from the United Kingdom and may incur duty and other charges upon entering other countries. Any duty, clearance, tax or carrier charges must be borne by the recipient and LS will not accept liability for any such duties, costs or charges.

(l)    Unfortunately, LS has no control over any duty, clearance, tax or carrier charges and cannot predict what they may be, so LS is unable to offer any assistance as regards these.

(m) Please note that the recipient of the Product, not the person placing the order, will typically receive a separate request for payment of any duty, clearance, tax or carrier charges when the Product arrives in the country of destination. Therefore, if you are ordering a Product to be delivered to someone else, please ensure they are aware that they will be responsible for any duty, clearance, tax or carrier charges.

(n)  All international deliveries use a tracked service and must be signed for on receipt.

(o)  If you have not received your order five working days after the estimated delivery date, please call LS on 020 7616 8570 (11am to 4pm Monday to Friday, excluding Exclusion Days) or email [email protected]. Please ensure that you have your order number and tracking number when contacting LS.

  1. Order tracking

You can track your order status at any time following receipt of the tracking reference number under paragraph 4.6. Once you have received your tracking reference number, simply click on the link provided, or here to obtain an update on your order.

  1. Returns and Exchanges

(a)  Subject to paragraph 6, you may return an unwanted Product, within 28 days to receive a full refund or replacement on the condition that the Product is unused and in a saleable condition within its original and undamaged packaging.

(b)  When returning an unwanted Product or Defective Product, please email: [email protected] with:

(i)    the order reference number;

(ii)   your full name, email address and delivery address;

(iii)  contact telephone number;

(iv)  the date; and

(v)   the reason for returning the unwanted Product or Defective Product and whether you are seeking a replacement or a reimbursement.

Please ensure you include your original dispatch note with your return.

(c)   Please return any unwanted Product or Defective Product to: London Spirit, Lord’s Shop, Marylebone Cricket Club, Lord’s Ground, London NW8 8QN.

(d)  Provided that the unwanted Product or Defective Product is returned in its original condition, LS shall replace or reimburse you in British Pound Sterling within 14 days after the day LS received back from you, the unwanted Product or Defective Product. Any reimbursement will be made to the original credit or debit card used when you placed your order. Please be aware that you will not be entitled to a refund if Products are returned to LS in an unacceptable or used condition, as determined by LS in its reasonable opinion.

(e)  If you need to return an unwanted Product or Defective Product because of an error by LS, LS will refund your delivery charges in returning it.

(f)   LS cannot be held responsible for any returned packages containing the unwanted Product or Defective Product lost in transit. As you are responsible for returning the unwanted Product or Defective Product, LS recommends sending the packages by recorded or special delivery and retaining proof of postage.

(g)  With the exception of Defective Products, your statutory right to cancel does not apply to the following:

(i)    face coverings, underwear, swimwear and nightwear;

(ii)   any personalised items or bespoke orders; and/or

(iii)  perishable goods.

  1. Limitation of liability

LS’s total liability to you for any claim by you arising out of your order and/or these Terms & Conditions shall not exceed the price of the Products supplied, together with, in the case of Defective Products or incorrect deliveries, any delivery charges incurred by you. LS shall not be liable for any indirect or consequential loss, including without limitation, financial loss such as loss of profit or otherwise, whether this arises from a breach of duty in contract or in any other way.

LS cannot accept any liability for a failure to comply with specific instructions stated on your order form. Nothing in these Terms & Conditions limits or excludes LS’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be limited under applicable law.

  1. Events beyond LS’s reasonable control

LS will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause that is beyond its reasonable control. This condition does not affect your statutory rights.

  1. Data protection

(a)  LS’s Privacy Notice is available at www.londonspirit.com.

(b)  Your privacy and personal information are important to LS. Any personal information that you provide to LS will be processed in accordance with the Privacy Notice, which explains what personal information LS collects from you, how and why LS collects, stores, uses and shares such information, your rights in relation to your personal information and how to contact LS and supervisory authorities if you have a query or complaint about the use of your personal information, and applicable data protection law.

  1. Access to the Platform

Whilst LS will try to ensure that availability of this Platform will be uninterrupted and that transmissions will be error-free due to the nature of the Internet, this cannot be guaranteed. Also, your access to this Platform may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. LS will attempt to limit the frequency and duration of any such suspension or restriction.

  1. Copyright and database rights

(a)  You acknowledge that all content included on this Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, as between LS and you, is the property of LS, shall remain vested in LS and is protected by UK and international copyright laws.

(b)  You are permitted to use the content only as expressly authorised by LS. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract for re-utilisation any parts of this Platform without LS express written consent and nor may you create or publish your own database that features substantial parts of this Platform (e.g. LS’s prices and Product listings) without LS’s prior express written consent.

  1. Alteration of service or amendments to these Terms & Conditions

LS reserves the right to make changes to this Platform, and these Terms & Conditions at any time. If any of these Terms & Conditions is deemed invalid, void, or for any reason unenforceable, that term or condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

  1. Third party rights

(a)  No one other than you has any right to enforce any provision of these Terms & Conditions.

  1. Law and jurisdiction

These Terms & Conditions shall be subject to English law. All claims or disputes arising in relation to or in connection with any order for Products under these Terms & Conditions shall be governed by English law.
